Instructions for Form 709

Example Filled-in Forms 709 for a couple, John and Mary, who have two children.

Example 1: John makes 529 contributions for one of the children in excess of his $15,000 annual exclusion, but by splitting gifts with Mary, the gifts are now below the annual exclusion amounts. The five-year spreading election is not needed.

Example 2: Mary does not consent to split gifts with John, and so John makes the five-year spreading election to bring his 529 contribution below the $15,000 annual exclusion amount.
