Find A 529 Pro Directory Agreement Savingforcollege.com LLC
Please read the following Agreement before applying for listing in the Find a 529 Pro Directory. Please acknowledge your agreement with these terms and conditions by executing this Agreement through the submission of your registration and your completed exam to Savingforcollege.com, LLC.
The Find a 529 Pro Directory (the “Directory”) is an online directory of professional consultants with knowledge on college planning and qualified state tuition programs. The Directory is intended to provide investors and others seeking professional advice with a way to locate a proximate professional consultant. In order to be included in the Directory, you must (i) personally be in the business of providing investment, legal, or tax services or products to individual clients; (ii) pay an annual listing fee to Savingforcollege.com LLC; (iii) pass an examination regarding 529 Plans and related topics, administered by Savingforcollege.com, LLC; and (iv) agree to this Agreement by submission of your registration and your completed exam to Savingforcollege.com, LLC. You may not have a listing that covers more than one consultant in your company; however, different consultants in your company may each apply for their own listing. You are responsible for ensuring that the information that appears in the Directory meets any requirements and standards under your professional or securities license. Savingforcollege.com, LLC assumes you have cleared your listing through all necessary channels before submission of registration.
Your listing in the Directory does not constitute an endorsement or recommendation of your products and/or services by Savingforcollege.com, LLC. You may not make any statements or produce any materials that in any way suggest that you are recommended by, or affiliated with, Savingforcollege.com, LLC. The exam you take as a requirement for listing confers no designation or certification and does not provide credit satisfying any continuing education requirements in your particular profession. Savingforcollege.com, LLC: (i) is not responsible for the content or accuracy of the information contained in your listing; (ii) has no involvement with the products and/or services that you may provide to individuals or entities that come to you through this Directory; and (iii) is not responsible for the client contacts you receive as a result of your listing with the Directory.
Prior to inclusion in the listing, you must pass an electronic exam administered by Savingforcollege.com, LLC, consisting of 25 questions covering Section 529 and related college planning topics. The Savingforcollege.com website, specifically 529 Pro Solutions, is to be used as reference for the exam. Savingforcollege.com, LLC will activate the 529 Pro Directory exam link in the "Manage Account" area of the website. After completing the electronic exam you will be sent results via email.
The exam is intended to provide an indication to Savingforcollege.com, LLC that you have general knowledge in the area of qualified state tuition programs and related college planning topics. If you do not pass the exam, you have the opportunity to take the exam three times at no extra cost.
A maximum number of two re-tests will be administered to a consultant during the initial listing and ensuing renewal process. First-time listings will be activated only after a passing score is received. Renewal listings will remain active through the re-test process, but will be deactivated if the consultant does not pass the final re-test or fails to take the re-test with-in 30 days of renewal or log the 6 hours required continuing education credits. If a consultant fails to meet the requirements after completing the above described testing process, their listing will be deactivated (if applicable) but their subscription to 529 Pro Solutions will remain active. The consultant will not be eligible for a refund. After 6 months, the professional may petition to take another re-test.
A "basic" listing contains your name, credentials, company, title, disclaimer (if required by your compliance department), state(s) that you are registered and/ or licensed in, address, telephone number, fax, a link to your personal or company web site, and e-mail address and e-mail address. For an additional cost per year, you may request a "Platinum" listing that contains all basic features plus the opportunity to describe your services and specialized expertise, larger font, and will be highlighted.
Your listing will remain active in the Directory until your 529 Pro Solutions subscription expires or until you no longer meet the testing/continuing education requirements.
Savingforcollege.com, LLC may increase the exam administration fee and the cost of the basic and platinum listings at any time. Fees associated with subsequent renewals will be based on prices in effect at the time of your renewal.
Savingforcollege.com, LLC provides this service to you without warranty of any kind, express or implied. In no event shall Savingforcollege.com, LLC be liable to you for any consequential, incidental, indirect or punitive damages, including any lost profits or lost savings, in contract, tort or otherwise, even if Savingforcollege.com, LLC has been advised of the possibility of such damages.
You agree to indemnify and hold Savingforcollege.com, LLC, its officers, directors, employees, and agents harmless from any and all liabilities, claims, losses, obligations, actions, demands, costs, and expenses, including attorneys’ fees, which may arise out of your acts or omissions in connection with any services performed by you or your agent on behalf of a user of the Directory.
Savingforcollege.com, LLC reserves the right in its sole discretion to deny or revoke your listing at any time and for any reason.
Savingforcollege.com, LLC cannot be held responsible for any internal compliance decision resulting in your removal from the Directory. If the Directory does not meet the standards of your company’s legal or compliance departments you will not be eligible for a refund. After your formal request for deactivation from the Directory you will retain any associated benefits (529 Pro Solutions) for the remainder of your subscription period. It is our recommendation that you check with your legal and compliance departments prior to joining the Directory.
The terms and conditions contained in this letter shall be binding upon and inure to the benefit of the parties, their personal representatives, successors, and assigns. This letter contains the entire understanding between the parties and supersedes any prior understanding, memoranda, or other written or oral agreements between the parties with respect to the subject matter herein. No modification or waiver of this letter or any part hereof shall be effective unless in writing and signed by both parties. This letter and all rights of the parties shall be governed by and construed in accordance with, the laws of the State of New York pertaining to contracts made and to be wholly performed within such state, without taking into account conflicts of laws principles.
By submission of your registration to Savingforcollege.com, LLC and completing the electronic exam, you hereby agree to be bound by any and all terms and conditions specified herein.
